Most of our general Terms & Conditions are in accordance to the Malaysia’s TOURISM INDUSTRY ACT 1992 Fourth Schedule (Subparagraph 6(1)(m)(ii)).
Other than the terms and conditions, do read the importance of our Privacy Policy and Fulfilment Policy as well. The general terms and conditions as well as other policies may differ from time to time. We would advise you to check it before making any orders.
Azuki Tours Sdn Bhd has a registered address at 26-3, Jalan Dinar A, U3/A, Taman Subang Perdana, Seksyen U3, 40150 Shah Alam, Selangor, Malaysia. Our business license no. 1018764-A, is registered and governed by the Companies Commission of Malaysia (SSM); a statutory body in Malaysia which regulates companies and businesses. In addition to that we are a licensed Travel Agency under the Ministry of Tourism, Arts and Culture no. KPK/LN 7309; a ministry under the Government of Malaysia that is responsible for tourism, culture, archives, library, museum, heritage, arts, theatre, handicraft, visual arts, convention, exhibition, Islamic tourism and craft. We have the legal licensed to sell tour packages of both inbound and outbound tours under the brand of Azuki Tours, a company registered in Malaysia.

Terms & Conditions for online shoppers
1) TOUR CONDITIONS
Flights
- Flight timing and Schedules are not guaranteed. They are regulated under the Aviation or Government Authorities. Neither Azuki Tours nor the Carrier concerned will accept liability for reasons of flight cancellations, delays or diversions that is not within its control.
- Scheduled flights that has been booked cannot be cancelled and non-refundable
- Check-in and hand carry luggage weight is regulated as per Airline’s terms and conditions. Free airline baggage allowance is provided by the airlines and the quantum and conditions may differ from one airline to another and from one airport authority to another. The same applies for hand-carried baggage aboard the aircraft. Additional baggage weight must be bear by the travelers themselves
- Change of flight dates is subject to Airline’s availability with applicable additional surcharges
- Change of Airlines once full payment has been made is not allowed
- Airport taxes and fuel surcharges does not form part of the tour fare and it should be borne by the passenger
- Airline schedules or local conditions may require sightseeing tours, hotels and routes to be changed. Should this occur, Azuki Tours shall make alternative arrangements subject to local conditions
- Deportation or refusal of entry of tourists by Immigration Authorities due to possession of unlawful items or holding improper travel documents or any other causes which are considered as subversive by the local and foreign government concerned are not the liability of Azuki Tours
- All passengers need to have a minimum of 6 months passport validity from the return date. Azuki Tours are not liable to remind passengers to renew the passport if the validity form the return date is less than 6 months
Package Tours
Terms for both FIT (Free Independent Traveler) and GIT (Group Inclusive Tour):
- All our items are under Normal Tours unless specified as Promotion Tours. Normal Tours are not applicable for any offers unless specified in the itinerary
- Information in the tour itineraries online is correct to the best of the Azuki Tour’s knowledge at the time of print, but Azuki Tours is unable to guarantee that any item or amenity mentioned will always be available, especially where Azuki Tours has no direct control over it. In the event of any inconsistency between the English version and the other language translation of the information, the English version shall prevail
- Azuki Tours including our employees and tourist guides act only as an agent for services rendered on behalf of 3rd party including for the transportation companies, hotel contractors, sightseeing attraction places which issues tickets, vouchers and others. Thus, Azuki Tours has to comply with those terms and conditions under which are lay-out by the 3rd party providers and Tourists must comply to the terms and conditions as well indirectly
- Itineraries of the sightseeing are as sample of guidance only. Original time may differ
- We take no responsibility on unforeseen circumstances beyond our control such as delayed or cancelled flights, trains or other connections which may exceed the estimated timeframe
- The durations of all travelling time in the itinerary is estimated based on the average driving conditions
- Tours are on a twin basis sharing only. Additional person including children below 12 years old will be charged accordingly. Babies below 2 years old may depend on airlines or hotel requirements.
- Single supplement (Person travelling alone) will need to pay surcharge price either by choice or unforeseen circumstance
- All meals, sightseeing places, included, excluded and other items will be specified in the itineraries
- Should you require extension of nights, hotel room is subject to availability with applicable additional surcharges. However, the extensions are not confirmed unless you receive a written notification from Azuki Tours
- Azuki Tours has the rights to amend or cancel the itineraries in short notice without getting any consent from the customers. The decision of Azuki Tours shall be final and conclusive and no liabilities whatsoever shall be incurred by Azuki Tours for such amendments or cancellation
- Please ensure to take care of your own passport unless tourists prefer the Tour Leader to hold the passport when travelling in a group. Please take note that, in any circumstances Azuki Tours cannot be held liable for any loss of passport due to any reason whatsoever including without limitations, negligence on the part of our employees, agents and servants
- Please refer Payment Policy for all confirmed bookings
- In case of emergencies and the need of amendments of private tours, please ensure to write to enquiry@azukitours.com a minimum of 7 working days (in Malaysia) before the date of arrival. The changes may subject to 3rd party consent such as Hotels and Theme parks feedback whether it is allowable or not. However, additional charges may apply
- Tourists are encouraged to have necessary vaccination, examine or do a health screening before visiting Malaysia to reduce the risks of unexpected health situation especially if it is the first time
- Items not included in the tour fare are:
a. Laundry;
b. Food and beverages not on regular menu;
c. Optional excursions;
d. Porter age at airport and hotels; and
e. All items of a personal nature
Terms for FIT (Free Independent Traveler):
- Tailor made private sightseeing without a local tourist guide may require customers to purchase entrance fees themselves
- Tailor made private sightseeing with a local tourist guide may sometimes require additional fees to the customers as they need to cover the guide’s fee as well. Tourist guide will normally do a favor to purchase the tickets on behalf of the customers. However, please take note that most guides can enter many attractions free of charge
Terms for GIT (Group Inclusive Tour):
- If the status of the tour is named as Guaranteed Departure Tour, it may refer to confirmed group tours with a minimum number of paxes which needs to be fulfilled. Should the conditions are not met , Azuki Tours has the rights to cancel the tour with a full refund or a replacement tour which is similar or in a different date
- A Tourist Guide must be included for a minimum of 7 paxes for international tourists
- Should there be any tourists who wishes to depart from the tour group separately, a notification of separation MUST be request in written at least 4 working days in advance. Additional charges may apply whenever possible. Azuki Tours will not be held liable and responsible for the tourists that departs from the group
- Tourist members who are difficult, undisciplined and uncooperative whose act and conduct are unreasonable and detrimental to the enjoyment, interest, well-being and safety of the other tour members will be dealt by the Tour Leader for example tourists who are not being punctual and causing other tour members uneasy. Tour leader has the right to request difficult tourist to leave the tour and his/her decision in this respect is final and conclusive. Azuki Tours will not refund any incomplete part of the tour
- Unfortunately, Azuki Tours is unable to provide needs and/or requirements of disabled/handicapped individuals. Azuki Tours would appreciate if special need tourists inform Azuki Tours during booking process just for record purposes. Azuki Tours urges all intending tourists with special needs to equip themselves with all special care that they may require. Nevertheless, Azuki Tours shall not be responsible for the above concerns in any manner whatsoever
Car rental or bus transfers
- Transfers via the bus are provided with an average of one sized suitcase and one piece of luggage per person or at the maximum free baggage allowance given by the Airlines.
- For private tours, due to the privacy policy, Airlines may not disclose certain passenger’s information to Travel Agents once checked-in has been made. Please ensure to contact us, if there is a flight delay of more than 2 hours or travelers are re-route with a different flight. Azuki Tours may impose additional charges if notifications are not given to our emergency contact number once pick-up time has been confirmed.
- For group tours, please ensure that your home Travel Agency or Tour Leader contact us, if there is a flight delay of more than 2 hours or travelers are re-route with a different flight. This is to ensure bus drivers will be able to alert on the late departure.
- Please take note that bus drivers do not assist in check-ins in the airport, accommodations, ports or stations unless specifically stated in the itineraries
- All confirmed shared transfers are non-refundable and will be charged as cancellation charges
- No refund will be given for early return of your car rental vehicle
- Additional charges will be applied should the fuel is not filled up to full tank upon return of car rental vehicle
Visa Application
- Tourists are encouraged to apply their visas on their own as the approval cannot be guaranteed. However, tourists who require visa applications are subjected to the terms and conditions of the respective authorities. Azuki Tours only act as an agency to collect the above charges and do not hold responsibility and would be unable to guarantee the approval of the visa application
- The following terms and conditions apply to all visa applications via Azuki Tours:
a. All fees, service charges and visa levied shall be borne entirely by the tourists
b. If the application of Visa is rejected, all the payments made are non-refundable
c. Should the visa application is approved and yet tourists are refused entrance by the immigration authorities from holding improper documents, possessing unlawful items or whatsoever reason, Azuki Tours shall not be held responsible or liable for any expenses, refunds or reimbursements of tour packages that has been paid
2) RATES & CURRENCIES
- All rates quoted are net and non-commissionable, inclusive of all taxes and service charges.
- The rates in EUR and MYR displayed are an estimation figure with an exchange fixed rate of 5.1 from EUR to MYR
- Exact exchange rates are unverifiable from EUR to MYR and can only be determined by the Bank as at when payment is being depending on the fluctuation of exchange rate levels
- Customers are allowed to choose either to pay in EUR or MYR
- Invoice will only be sent upon confirmation of currency by customer either in EUR or MYR as per the currency of
- We reserve the right to change prices offered on the site at any time but this will not affect the price of any bookings that have already been confirmed
3) TRAVEL INSURANCE
- Tourists are encouraged to purchase a domestic travel insurance when having the tours in Malaysia
- All tours taken by tourist falls under the risks of the tourist themselves. Azuki Tours is not responsible and should not be held liable in the following conditions:
a. Any inaccuracy, misspelling, misdescription, misleading or changes to any tour and its itinerary
b. Any additional expenses due to delays or changes in any transport services, sickness, weather, strikes, war, quarantine or other causes
c. Any damage or loss baggage or other personal effects or accidents happened during the tours falls under the responsibility of the tourists themselves
d. Tourists are responsible themselves if they would like to request claims or applications forms whatsoever with the insurance companies
e. Azuki Tours is able to assist with insurance claims with good conduct and as a favor but not to be held responsible only upon request subject that the domestic insurance is purchased with Azuki Tours
f. If luggage is lost or damaged due to the negligence of Azuki Tours during the tour or its employees, tourist guides or agents, the maximum liability per baggage will be MYR200.00 only
4) REFUNDS
- Refunds are only applicable for ground tours only
- Refunds are not applicable to flight tickets as well as shared transfers
- No refund or reduction will be made to any member in respect of airfare, accommodation, meals sightseeing tours, transport or any other services which are included in the tour fare out not utilized by the tour member due to personal reasons
5) BOOKING PROCEDURES

6) RESERVATIONS
Bookings and request of quotations can be made directly via our online website or via email. Our sales department will reply with the quotation within 48 hours. All reservations must be made in writing

7) PAYMENT INSTRUCTION
- Payment is valid only after our bank has confirmed the receipt of the payment made from your end
- If payment is made in the currency other than the currency contracted in the quotation, Azuki
- Tours shall reserve the right to convert the payment at such foreign exchange rate quoted by its account bank or as per the rates agreed
- Tourists should make pay the exact amount and free from any bank charges, any withholding tax, deduction and counterclaim or whatsoever
- Our methods of payment are as follows:

Credit Card payment
- Azuki Tours have the rights to select tourists who wish to pay using credit card payments
- Upon agreeing to the quotations, then only we will provide the link for payments via credit cards
- We accept visa and master card only
8) DEPOSIT
- A 50% deposit is required to enable us to proceed with booking confirmation.
- Balance of payment must be received 60 days for FIT and 75 days for GIT before the date of arrival. Failing, the company reserves the right to cancel all arrangements for the aid-confirmed booking without any prior notice. Payment in the form of Online or Telegraphic Transfer must be made to enable us to proceed with confirmation of booking/reservation. Cheques are not accepted.
- Payment Could be made via telegraphic transfer to our bank as stated in Azuki Tours Terms & Conditions item no. 7.
- All bank charges through payment made by telegraphic transfer will be strictly borne by the payer.
- A copy of remittance advice must be forwarded to the company as proof that payment has been made.
- All payments must be received before the due dates stipulated herein. Invoice no. must be included with the wire/electronic transfer.
- Azuki Tours Sdn. Bhd. reserves the right to cancel the reservation which has not been fully paid within the time stipulated.
9) AMENDMENTS
Amendment terms for FIT (Free Independent Traveler):
- Upon confirmation of the tour any subsequent change made to the reservation is subject to an amendment charge of RM50.00 per person per change
- No change can be made within 8 working days before the date of departure.
- Changing the entire reservation constitutes a cancellation of the original reservation and is subject to cancellation charges as defined in the cancellation policy (see clause 3.1 – for FIT tour packages)
Amendment terms for GIT (Group Inclusive Tour):
- Upon confirmation of the tour no changes can be made to the reservation within 14 days before the date of departure
- However, any request from any member for any change to come back earlier or later than the group will be subject to the conditions of the respective airlines
- Changing the entire reservation constitutes a cancellation of the original reservation
10) CANCELLATION FOR GROUND TOUR ONLY (BY TRAVELER)
TOURS: Hotels, carriers, restaurants, and services contractors will impose cancellation fees depending on the circumstances of the cancellation in relation to your cancellation.
A cancellation will only be effective when we receive written confirmation of the cancellation, early departures, postponed tour, or reduction in confirmed booking within the following period.
Cancellation Terms for FIT (Free Independent Traveller)
i. 60 days prior to arrival: 10% cancellation fee on the cancelled component
ii. 45 days prior to arrival: 50% cancellation fee on the cancelled component
iii. Less than 30 days prior to arrival or No Show: 100% cancellation fee on the cancelled component
Cancellation Terms for GIT (Group Inclusive Tour)
i. 75 days prior to arrival: 10% cancellation fee on the cancelled component
ii. 60 days prior to arrival: 50% cancellation fee on the cancelled component
iii. Less than 45 days prior to arrival or No Show: 100% cancellation fee on the cancelled component
Such cancellation fee(s) may vary on Third-Party Suppliers or other suppliers’ conditions. If you cancel any Product (including any element of a Package) you may incur cancellation charges from the Third-Party Providers supplying the cancelled Travel Product and you agree to indemnify Azuki Tours (and any related parties) for any fees or charges incurred by them in relation to your cancellation.
The respective airline’s cancellation policy on special promotional fare shall apply in addition to the cancellation charges as set out in clause 3.2.2 (Note : The airline ticket is restricted and subject to the Airline’s Terms and Conditions. It may be non-endorsable, non-issuable, non-refundable and non-routable. Any alteration in routing or change of date of travel by any passenger is solely at his own risk. Azuki Tours or its associated agents shall not be held responsible for any inconvenience caused and extra expenses incurred)
11) CANCELLATION FOR GROUND TOUR ONLY (BY AZUKI TOURS)
Cancellation terms for FIT (Free Independent Traveler):
- Azuki Tours reserves the right to cancel the tour due to any act of God, war, strike, riot or order from the Government of Malaysia which is beyond its control.
- Azuki Tours shall recommend alternative tours preferably to the same destination or other tours. Should any passenger decide not to accept the alternative tours, all moneys paid less the administrative fee chargeable will be refunded to the passenger.
Cancellation terms for GIT (Group Inclusive Tour):
- Azuki Tours reserves the right to cancel the tour due to any act of God, war, strike, riot or order from the Government of Malaysia which is beyond its control.
- Azuki Tours shall recommend alternative tours preferably to the same destination or other tours. Should any passenger decide not to accept the alternative tours, all money paid less the administrative fee chargeable will be refunded to the passenger
- In the event of a cancellation by Azuki Tours due to insufficient passengers or inability to secure seats or accommodation, Azuki Tours will refund the amount of money paid and also pay compensation as follows:

12) CLAIMS & COMPLAINTS
If the client has a complaint about his trip, the Client is to inform his group leader or our local representative at the time so that they can attempt to rectify the matter. If satisfaction is not reached through these means, then any further complaint should be put in writing to us within 15 days of the end of the tour.
13) AZUKI TOURS AND ITS PARTY SUPPLIER:
Azuki Tours makes arrangements with accommodation providers, activity providers, transfer operators, tour and local guides, and other independent parties (“Third Party Suppliers”) to provide the Client with the travel services and other services the Client purchases or which form the component parts of the Client’s product Tour.
Third Party Suppliers may also engage the services of local operators and/or sub-contractors for the provision of travel services that form part of the product Tour(s). Although Azuki Tours takes all reasonable care in selecting Third Party Suppliers, Azuki Tours is unable to control Third Party Suppliers and do not supervise Third Party Suppliers and therefore cannot be responsible for their acts or omissions. The travel services and other services provided are subject to the conditions imposed by these suppliers and their liability is limited by their tariffs, conditions of carriage, tickets and vouchers and international conventions and agreements that govern the provision of their services.
These may limit or exclude liability of the supplier. The Client acknowledges that Third Party Suppliers operate in compliance with the applicable laws of the countries in which they operate, and Azuki Tours does not warrant that any Third-Party Supplier is in compliance with the laws of the Client’s country of residence, or any other jurisdiction.
14) EXCLUSION OF LIABILITY
Azuki Tours is not liable and will not assume responsibility for any claims, losses, damages, costs or expenses arising out of inconveniences, loss of enjoyment, upset, disappointment, distress or frustration, whether physical or mental, resulting from the act or omission of any party other than Azuki Tours and its employees.
For clarity, neither Azuki Tours nor any carrier is liable for the acts or omissions, whether negligent or otherwise, of Third-Party Suppliers or any independent contractors.
15) CONFIDENTIALITY
All quotation given to tourists or agents is private and confidential which may not be disclosed to third parties for whatever reason or purpose. Should the rates are disclosed without prior consent by Azuki Tours, it will be automatically void and Azuki Tours is not to be held responsible for any dispute that happened
16) FORCE MAJEURE
Azuki Tours will not be liable to tour members for any failure, delay or disruption or any impossibility to provide the Tour service, caused by a Force Majeure Event, whether or not such matter was foreseeable and such failure or delay will not constitute a material breach of this agreement. A “Force Majeure Event” may include to Acts of God for example flood, war within Malaysia and local governmental authority at any time 30 days prior to Customer’s arrival date, disaster, strikes, civil disorder within thirty (30) miles of the Hotel, curtailment of transportation facilities, or any other emergency making it illegal or impossible to provide the facilities. This contract may be terminated without a cancellation charge for any of the above reasons by written notice from one party to the other. The contract shall be governed by and constrained in accordance with laws of Malaysia
17) VALIDITY PERIOD
The validity of the rates online are valid from immediate effect until further notice and subject to change without prior
18) RIGHT TO REJECT
Azuki Tours reserves the right to cancel or withdraw any itinerary, or any reservation made for a client or decline to accept or retain any person from being a tour member if he is likely to endanger the health or safety, or impair the comfort of enjoyment, of others on the tour. Azuki Tours further reserves the right to cancel the reservation if for any other reason any carrier, hotel or other contractor refuses to allow any participant to participate in the tours. If any of such events, Azuki Tours’s sole liability shall be to refund to the tour member any moneys paid, less the amounts for services already utilized, and the administration and cancellation fees provided the tour has not commenced
19) LITIGATION
In case of litigation, the parties here to agree that the same shall be exclusively filed and prosecuted within the jurisdiction and territory of Malaysia
Note:
Azuki reserves the right to publish or print any photographic materials taken during the tour for advertising, promotional and other purposes, in any manner, in any and all media, now or hereafter devised, without further payment or consideration, notification or permission
